Terms of Service

1. The Agreement

By accessing isaveondelivery.com or using The Self-Delivery Switch, you agree to be bound by these Terms of Service. This is a legally binding agreement between I Save On Delivery, LLC ("Agency") and your business ("Merchant").

2. Description of Service

ISOD provides a logistics integration service designed to facilitate self-delivery fulfillment for orders originating from third-party marketplaces. The Agency does not own the delivery vehicles or employ the drivers directly; we act as a logistics orchestration layer between your POS system and independent driver networks.

3. Fees & Performance

Merchant agrees to pay the service fees as outlined in their specific fulfillment agreement. Typically, this includes a percentage of the gross order value (e.g., 5%) for the The Self-Delivery Switch orchestration. Marketplace commissions (e.g., 15%) remain the responsibility of the Merchant and are paid directly to the respective platforms (DoorDash, Grubhub, etc.).

4. Merchant Obligations

The Merchant is responsible for:

  • Providing accurate POS API access and marketplace credentials.
  • Ensuring food is prepared and ready for pickup at the dispatched time.
  • Maintaining a stable internet connection for order transmission.

5. Liability Limitations

ISOD shall not be liable for any indirect, incidental, or consequential damages arising from:

  • Delays in driver arrival or order delivery times.
  • Issues related to food quality or temperature once it leaves the Merchant's premises.
  • Downtime or technical errors in the third-party marketplace platforms.

6. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, any outstanding service fees owed to the Agency become immediately payable.

Governing Law

These terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Bexar County, Texas.
